is a 4 page policy agreement, is something every business that caters to the public, that uses independent contractors (booth renters), AND employees should have in force. In the current lawsuit happy environment, every salon, and nail salon should have these in force. You can be sued for anything these days, and it seems that sexual harassment is the "latest" one! You hear about it every day!
By federal law, you can't tell independent contractors what to do, or how to run their business. Therefore you (personally), or your salon (also you) could be held liable for sexual harassment claims, from your employees, or booth renter's customers, Workman's Compensation claims, or THEIR taxes, if you don't have some protection, in the form of an established (written, signed and witnessed) contract, policy, or waiver!

Sole Proprietor Waiver
This is a waiver; a document that your Independent Contractor (Sole Proprietor/booth renter) signs, WAIVING their right to Worker's Compensation coverage. Generally, this is between the worker, and the business owner. States, cities and counties don't like to pay out Workmen's Compensation claims if someone is sick or gets
hurt... IF they can collect from the business owner. Before they pay the claims, they'll generally go for the "deepest pockets." (Those of the business owner.)
This waiver then, goes a long way in absolving the business (salon) owner, and makes sure the independent contractor (renter/Sole Proprietor) realizes that they,
must have Workman's Compensation coverage for themselves, and any people THEY hire. This is so costs don't bounce back on (you) the business owner.
HYBRID (Special Situations)
Independent Contractor (Station/booth) Agreement
This is a "special" (two page) booth renter contracagreement. It can be a daily, weekly, or monthly agreement, geared to businesses that have several different types of independent contractors/booth renters, and related situations. This agreement generally absolves the owner of having to have "special situation" addendums attached to the original booth renter agreement/s. Addendums are generally very costly if done by an attorney. We feel it's a lot less expensive to have this one filled out,
and have an attorney read it... as opposed to your paying hundreds of dollars to have one drawn up.
If (for example); you have people only working one day in your place of business, somewhere else another day, working at home another day, in an institution another day, you have this agreement in force, showing city, county, state, and federal tax authorities, that you're doing your best to comply with regulations regarding independent contractors...those who work in more than one place.
You need to put these policies into effect NOW, for your own peace of mind! Every forward looking up-to-date salon or business, should have these policies in force for their protection.
